International Competitive Services Product and Price Changes Correction

SUMMARY:
The Postal Service published a final notice in the Federal Register, 86 FR 67862-67864, on November 30, 2021, regarding the revisions to Mailing Standards of the United States Postal Service, International Mail Manual (IMM®), to reflect the prices, product features, and classification changes to Competitive Services and other minor changes, as established by the Governors of the Postal Service effective January 9, 2022. That document contained an error in the Certificate of Mailing Individual Pieces chart in that it incorrectly listed the firm mailing sheet (PS Form 3665), per piece (minimum 3) First-Class Mail International only with the price for all other qualifying classes of mail. There is no price change to First Class Mail International only. This document serves to correct the error by replacing First Class Mail International only to reflect all other qualifying classes of mail.

Periodicals Pending Authorization Postage

SUMMARY:
The Postal Service is amending Mailing Standards of the United States Postal Service, Domestic Mail Manual (DMM®) subsection 207.5.2 to revise the process for calculating postage on a Periodicals publication pending authorization.

SUPPLEMENTARY INFORMATION:
On September 30, 2021, the Postal Service published a notice of proposed rulemaking (86 FR 54142) to revise the postage calculation standards for Periodicals pending authorization. In response to the proposed rule, four commenters submitted comments.
Comment: One commenter supported the proposal changes, stating that it would make pricing Pending periodicals more efficient and effective.
USPS Response: The Postal Service is grateful for the support.
Comment: One commenter opposed the proposal, characterizing it as a price increase unsupported by data, analysis, or fiscal studies that would assess its effects.

Treatment of E-Cigarettes in the Mail
AGENCY: Postal Service™.
ACTION: Final rule.
SUMMARY:
The Postal Service revises its regulations in Publication 52, Hazardous, Restricted, and Perishable Mail, to incorporate new statutory restrictions on the mailing of electronic nicotine delivery systems. Like cigarettes and smokeless tobacco, such items are generally nonmailable, subject to certain exceptions.

Background
The Postal Service hereby amends Publication 52, Hazardous, Restricted, and Perishable Mail, with the provisions set forth herein. While not codified in Title 39, Code of Federal Regulations (“CFR”), Publication 52 is a regulation of the Postal Service, and changes to it may be published in the Federal Register. 39 CFR 211.2(a)(2). Moreover, Publication 52 is incorporated by reference into Mailing Standards of the United States Postal Service, Domestic Mail Manual (“DMM”) section 601.8.1, which is incorporated by reference, in turn, into the Code of Federal Regulations. 39 CFR 111.1, 111.3. Publication 52 is publicly available, in a read-only format, via the Postal Explorer® website at https://pe.usps.com. In addition, links to Postal Explorer are provided on the landing page of USPS.com, the Postal Service’s primary customer-facing website; and Postal Pro, an online informational source available to postal customers.

SUPPLEMENTARY INFORMATION:
Currently, postage for Periodicals pending authorization is calculated by completing a PS Form 3541, Postage Statement-Periodicals, and charging the price for the applicable class of mail determined by the eligibility of the mailpiece. Based on the numerous pricing differences in Periodicals and other classes of mail, this process is labor intensive and does not provide exact pricing.

Treatment of Regulations on Hazardous, Restricted, and Perishable Mail

SUMMARY: The Postal Service amends certain regulations to clarify the regulatory treatment of Publication 52, Hazardous, Restricted, and Perishable Mail.

SUPPLEMENTARY INFORMATION:
The Postal Service has long maintained regulations on hazardous, restricted, and perishable mail. For many years, those regulations were located in Mailing Standards of the United States Postal Service, Domestic Mail Manual (“DMM”). The DMM is a regulation of the Postal Service. 39 CFR 211.2(a)(2). Annual editions of the DMM are incorporated by reference into 39 CFR 111.1. As explained in Postal Service regulations, interim regulations are published in the DMM pending the next volume’s incorporation into the Code of Federal Regulations, and changes to the DMM are announced in the Federal Register. 39 CFR 111.3. As an additional reference, the Postal Service developed Publication 52, Hazardous, Restricted, and Perishable Mail.

New Mailing Standards for Domestic Mailing Services Products

SUMMARY:
On May 28, 2021, the Postal Service (USPS®) filed a notice of mailing services price adjustments with the Postal Regulatory Commission (PRC), effective August 29, 2021. On June 23, 2021 USPS further filed a notice to change the maximum size limitation for presorted First-Class Mail postcards. This final rule contains the revisions to Mailing Standards of the United States Postal Service, Domestic Mail Manual (DMM®) to implement the changes coincident with the price adjustments and postcard size limitation changes.

On July 19, 2021 the PRC favorably reviewed the price adjustments proposed by the Postal Service. On July 28, 2021, the PRC favorably reviewed the presorted postcard maximum size limitations proposed by the Postal Service. The price adjustments, presorted postcard maximum limitations and DMM revisions are scheduled to become effective on August 29, 2021. Final prices are available under Docket No. R2021-2 (Order No. 5937), and presorted postcard maximum size limitations are available under Docket No. MC2021-104 (Order No. 5946) on the Postal Regulatory Commission’s Web site at www.prc.gov.

International Mailing Services: Price Changes

SUMMARY:
On May 28, 2021, the Postal Service published proposed price changes to reflect a notice of price adjustments filed with the Postal Regulatory Commission (PRC). The PRC found that price adjustments contained in the Postal Service’s notification may go into effect on August 29, 2021. The Postal Service will revise Notice 123, Price List to reflect the new prices.

I. Proposed Rule and Response
On May 28, 2021, the Postal Service filed a notice with the PRC in Docket Number R2021-2 of mailing services price adjustments to be effective on August 29, 2021. On June 3, 2021, USPS® published a notification of proposed price changes in the Federal Register entitled “International Mailing Services: Proposed Price Changes” (86 FR 29732). The notification included price changes that the Postal Service would adopt for services covered by Mailing Standards of the United States Postal Service, International Mail Manual (IMM®) and publish in Notice 123, Price List, on Postal Explorer® at pe.usps.com. The Postal Service received no comments.

Addressing Standards

SUMMARY:
The Postal Service is extending its effort to improve the delivery point validation and address standardization of mail receiving postage discounts by amending the Mailing Standards of the United States Postal Service, Domestic Mail Manual (DMM®) in various sections of 602, Addressing, to update addressing standards.

Treatment of E-Cigarettes in the Mail

ACTION: Notice.
SUMMARY:
A forthcoming final rule will determine whether electronic nicotine delivery systems (“ENDS”) may continue to be mailed pursuant to certain statutory exceptions that are currently administered through an application process. To the extent that such exceptions may ultimately be made available for ENDS, this notice provides mailers with guidance to assist in preparing exception applications for submission following the final rule. In addition, ENDS mailers are advised to review and comply with all other applicable mailing restrictions and requirements currently in effect for controlled substances, drug paraphernalia, and hazardous materials.

SUPPLEMENTARY INFORMATION:
On February 19, 2021, the Postal Service published a notice of proposed rulemaking to amend Publication 52, Hazardous, Restricted, and Perishable Mail, which is incorporated by reference into 39 C.F.R. Part 113. The text of the proposed edits to Publication 52 is available at https://pe.usps.com/FederalRegisterNotice/2021/E-Cigarettes%20Proposed%20Rule.pdf. The proposed edits would implement the Preventing Online Sales of E-Cigarettes to Children Act (“Act”), Pub. L. No. 116-160, div. FF, title VI (2020), which adds “electronic nicotine delivery systems” (“ENDS”) to the definition of “cigarettes” subject to regulation under the Jenkins Act, 15 U.S.C. 375 et seq. Consequently, ENDS will also become subject to the mailability restrictions and exceptions in 18 U.S.C. 1716E (“PACT Act”), which rely on the Jenkins Act definition of “cigarettes.” 18 U.S.C. 1716E(a)(1).

Priority Mail Express Delivery Times

The Postal Service is amending Mailing Standards of the United States Postal Service, Domestic Mail Manual (DMM®) in various sections to revise the Priority Mail Express® delivery times and to eliminate the optional 10:30 a.m. delivery time.

Currently, the Priority Mail Express service guarantee delivery times for most domestic mail including Priority Mail Express Military Service® and Hold For Pickup service. are 12:00 p.m. or 3:00 p.m. as designated by the 3-digit or 5-digit destination ZIP® Code delivery areas and defined in the Priority Mail Express Delivery directory. The Postal Service is revising the 12:00 p.m. and 3:00 p.m. Priority Mail Express service guarantee delivery times to 6:00 p.m. The Postal Service is also eliminating the optional 10:30 a.m. delivery time.

Extra Services Refund Time Limit

SUPPLEMENTARY INFORMATION:
On May 14, 2020, the Postal Service published a notice of proposed rulemaking (85 FR 28917-28918) to revise the time limit for extra service refunds on all classes of mail except Priority Mail Express®. The Postal Service elected to issue a second revised proposed rule on January 7, 2021, (86 FR 1080-1081) that included revising the timelines for Priority Mail Express with an extra service. One formal response was received as follows:
Comment: The commenter requested the time limit for extra service refunds be revised on all classes of mail except Priority Mail Express.
USPS Response: The Postal Services believes this revision to extend the time limits for filing a refund for all classes of mail will provide consistency within the refund policy.
Currently, DMM Exhibit 604.9.2.1, Postage and Fees Refunds, provides that for Priority Mail Express with an extra service a customer must apply for an extra service refund no sooner than 10 days, or no later than 30 days, and for all other classes of mail with an extra service a customer must apply for an extra service refund no sooner than 10 days, or no later than 60 days, from the date the service was purchased.

Extra Services Refund Time Limit
AGENCY: Postal Service™.
ACTION: Proposed rule; revision; additional comment period.
SUMMARY: The Postal Service is revising its pending proposal to amend Mailing Standards of the United States Postal Service, Domestic Mail Manual (DMM®) in subsection 604.9.2 to revise the time limit for extra service refunds.
DATES: Submit comments on or before February 8, 2021.

SUPPLEMENTARY INFORMATION:
On May 14, 2020, the Postal Service published a notice of proposed rulemaking (85 FR 28917-28918) to revise the time limit for extra service refunds on all classes of mail except Priority Mail Express®. The Postal Service has elected to issue a second revised proposed rule that also includes revising the timelines for Priority Mail Express® with an extra service.
